Bhubaneswar (Orissa): By failing to present her during the Test Identification Parade of the accused in the rape case for the second consecutive times, the 29-year Catholic Nun seems in back foot with the case likely to weaken.

The sub-divisional judicial magistrate Baliguda in Kandhamal asked the Crime Branch of Orissa police to frame charges by November 24. CB has arrested 10 people in connection with rape case on August 25.

The SDJM said that since the alleged rape victim nun did not come for the test identification parade (TIP), the court's proceeding could not wait till her arrival.

The Court asked the Crime Branch to frame charges with whatever evidence it had gathered till now. As the TIP had not been conducted, the CB will not be able to produce "solid" evidence against any of the 10 persons arrested.

Among the 10 arrested persons, a father-son duo and two brothers were languishing in a jail at Baliguda despite no evidence against their name. This was however sources said, that the CB had conducted the DNA test on the 10 persons.

CB has also taken blood sample of the Nun at All India Institute of medical Science in New Delhi. If the DNA report not matches with the accused, the case may be died down, said a legal expert.
